1. Who we are and who engages us
We help owners navigate the sale of their business. An owner engages us as an independent contractor to market the business and coordinate the sale process. We work the sale from the seller's side of the table. We are not the agent of the seller or of any buyer, we do not act for or advise buyers, and we cannot bind either party.
Registering as a buyer, signing a confidentiality agreement, receiving information or talking with us does not make you our client. Your own lawyer papers the deal. Where a sale includes real property or a lease assignment, a licensed commercial realtor handles that part of the deal, not us.
2. Informational only; no advice
Content on this site, including listings, estimated valuation ranges, and articles, is general information. It is not legal, tax, accounting, investment, financing, real estate, securities, or valuation advice, and using the site creates no advisory relationship. Obtain independent professional advice before buying or selling a business.
An online estimate is an opinion for sale planning, built from the information you supply, stated assumptions, and general market multiples we do not independently audit. It is not a certified valuation, an appraisal, an offer, or a promise of price. Succession Market is not an accredited business valuator. Actual value depends on due diligence, buyer demand, structure, market conditions, and professional advice.
3. Listings and seller information
Listing information is provided by sellers and third parties; we do not warrant its accuracy or completeness. Buyers must rely on their own due diligence for all information, under a signed confidentiality agreement. A listing is an invitation to inquire, not an offer capable of acceptance: the seller may change the process, reject a proposal, negotiate with others, or stop the sale at any time. We may edit, anonymize, delay, reject, or remove a listing or submission at our discretion.
4. Registration information
You agree that information you submit is accurate, current, and concerns you or an entity you are authorized to represent. Identity, funding, and acquisition information is recorded as you declare it; we do not independently confirm it and make no representation to any seller about your financing or ability to complete a transaction. Registration does not create any promise of access, exclusivity, seller acceptance, or a transaction, and we may decline, limit, suspend, or cancel access where we reasonably consider it appropriate.
5. Confidentiality gates
Access to confidential listing information requires an accepted confidentiality agreement and compliance with the staged process for that listing. You must not identify or attempt to identify an anonymized business or seller, bypass Succession Market, contact a seller or a business's staff, customers, suppliers, or landlord without permission, share restricted material, or use listing information for a competitive or unrelated purpose. If these terms conflict with a confidentiality agreement you have accepted, the provision giving greater protection to seller information applies.
6. What you submit
You are responsible for what you submit: it must be lawful, accurate in all material respects, not misleading, and supplied with authority. Do not submit another person's sensitive personal information unless it is reasonably necessary and you are legally authorized to provide it. You grant us a limited right to host, copy, format, and use submitted information only to operate the requested service, administer a transaction, protect the platform, and comply with law. Keep your own originals.
7. Acceptable use
- No unlawful, fraudulent, or harmful use.
- No scraping, crawling, harvesting, republishing, or systematic extraction of site or listing data.
- No automated tools to identify confidential businesses or defeat access controls.
- No interference with security, availability, forms, or another person's access.
- No malware, no impersonation, and no misrepresenting your authority, funding, identity, or intentions.
- No uploading confidential material from this site to a public artificial intelligence service, and no using it to train a model.
- No using our name, listings, data, or process to approach a seller, buyer, employee, customer, supplier, or landlord outside the authorized process.
8. Emails and alerts
Opportunity alerts and other commercial messages are sent only with your consent, and every one carries a working unsubscribe. Withdrawing is one click, and service, security, and transaction messages may still be sent where reasonably necessary for an active request or relationship.
9. Intellectual property
The site, the Succession Market brand, listing formats, text, graphics, software, databases, and materials belong to us or our licensors. You get a limited, revocable right to use the public website for its intended business purpose, and nothing more. Do not copy, modify, sell, or build competing materials from our content without written permission.
10. Third party services
The site links to and relies on independent providers for hosting, analytics, communications, and professional services. We do not control and are not responsible for a third party's content, availability, advice, security, or terms.
11. Availability and security
We may change, suspend, or discontinue any site function, and we do not promise uninterrupted or error free operation. Protect your own credentials and devices, and report suspected unauthorized access promptly. Highly sensitive financial information should be supplied only through the secure method we designate, never through ordinary email.
12. No warranties
To the maximum extent permitted by law, the website and its public content are provided as is and as available, without implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or results. No disclaimer here limits an express obligation in a separate signed agreement.
13. Liability
To the maximum extent permitted by law, Succession Market and its personnel are not liable for indirect, special, punitive, or consequential loss, lost profit, lost opportunity, business interruption, or loss caused by reliance on information provided by sellers or third parties, third party services, unauthorized access, or a transaction that does not complete. For a claim arising only from use of the public website, where no separate signed agreement applies, our total aggregate liability is limited to the greater of $100 and the amount you paid us directly for the website service giving rise to the claim in the preceding six months. Nothing limits liability that cannot legally be limited, or liability for our fraud or wilful misconduct.
14. Your responsibility to us
You will indemnify Succession Market and its personnel against third party claims and reasonable costs caused by your unlawful activity, material misrepresentation, unauthorized submission or disclosure, circumvention, security interference, or breach of these terms.
15. Privacy
Personal information is handled per our Privacy Policy, which forms part of these terms.
16. Suspension
We may suspend or end access, remove a submission, and preserve relevant records where we reasonably believe you have breached these terms, created security or legal risk, interfered with a transaction, or harmed another person. Sections on confidentiality, acceptable use, intellectual property, liability, and your responsibility to us survive.
17. Changes, general, and governing law
We may update these terms; the current version is posted here with its effective date, and we will ask for renewed acceptance where a material change affects an active registration. If any provision is unenforceable it is trimmed to the minimum extent necessary and the rest continues. You may not assign rights under these terms; we may assign them to a successor that acquires the Succession Market business. These terms are governed by the laws of British Columbia and the laws of Canada applicable there, in the courts of British Columbia sitting in Kelowna.
